Important News… New Government Regulation Will Impact Your Business!

In an effort to keep you in the know, we wanted to make sure you are informed about the European Union’s (EU) General Data Protection Regulation (GDPR) that goes into effect on May 25, 2018.  The buzz is everywhere online and understandably… there is confusion.
While this law was created to protect the individual privacy rights of European residents, it impacts any business owner who reaches a world-wide audience, through their online presence, website, social media or assessments.

Here is a link so you can familiarize yourself with the GDPR legislation and see how it affects you, and what steps you might need to take to address the requirements of this new regulation.

We at Smart Biz Quiz and our parent company, Global Experts Accelerator, have been working diligently to have in place what you need to be in compliance with this new regulation.

What the GDPR Means for SBQ Clients.

While the GDPR is designed to protect individuals in the European Union, it also applies to any business involved in collecting and processing the personal data (name, email, phone number, etc.) of EU citizens, no matter where they’re located. Because your online presence connects you with clients around the world, any opt-in offers, assessments, etc. require prospects and clients to provide you with their personal data.

As a SBQ Client, you may be wondering how you can comply with this new regulation. As with any legal matter, we suggest you consult with an attorney, regarding your compliance obligations. However, if you process ANY personal data of EU residents, the GDPR will apply to you.

The GDPR’s main impact on SBQ Clients has to do with:

  • Processing data requests (“right to be forgotten” and “right of access”)
  • Freely given consent to send information, via email
  • Handling data sent to third-party services (CRM’s, 3rd Party plug-ins)

What we have put in place to help you.

  1. Before submitting your assessment, users need to understand and agree to the collection of their contact information. We are adding the following text, just above the Submit button.
    "The information submitted with this assessment or quiz will be processed and used by 'Your Name' for the purpose of sending you your assessment or quiz results."

    If your intention is to use their contact information for other purposes as well, such as periodically sending them newsletters, offers etc., we have added a section in the editor, in the Quiz Components Tab, where you can mention this, and the text entered here, will be appended to the above statement. See a sample of this text below:
    I understand I may also receive tips, newsletters and occasional invitations to trainings and offers, and I can choose to opt-out at any time”.

  2. We have added the email address that your quiz auto-responder are sent from to footer of your assessment.

Client Data Requests

As a SBQ Client, you are responsible for handling student data requests. Data requests can come in two forms:

  1. Right ofaccess, (data export of their contact information collected)
  2. Right to beforgotten (data deletion of their record)

SBQ has added a function to be able to comply with these requests. 

In the Quiz Results section, when you click on the client’s name, you will land on the Client’s record and be able to either download a JSON (machine readable format) file containing the data you collected on that particular client, so you can email it to them, or delete the client’s data from you SBQ Back Office. 

If you have CRM integration, you will also need make sure you comply with these requests from your CRM as well.

As a business owner, if you are using any 3rd party collection data services (CRM, Shopping Carts, Optin Pages, etc.,) the GDPR states that you may need explicit consent to collect data from your end user in the form of a “checkbox” that they must check to agree to the collection of this data and specific reason you are collecting such data.
